1. Acceptance of Terms
By booking a tour, safari, climb, or holiday with Kisaza Tours ("we", "us", or "our"), you accept and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the traveler/client) and Kisaza Tours. If you do not agree to these terms, you should not book our services.
2. Bookings, Deposits & Payments
To confirm a booking, the following payment terms apply:
- Deposit: A non-refundable deposit of 30% of the total tour price is required at the time of booking to secure reservations for hotels, lodges, and park permits.
- Final Payment: The remaining balance of 70% must be paid at least 30 days prior to the tour departure date. For bookings made within 30 days of departure, full payment is required immediately.
- Payment Methods: We accept payments via bank wire transfer and secure online credit card payments. All transaction fees are the responsibility of the client.
3. Cancellations & Refund Policy
If you need to cancel your booking, you must notify Kisaza Tours in writing. The cancellation fees are calculated based on the date we receive your written notification:
- More than 60 days before departure: Full refund minus the non-refundable deposit.
- 30 to 60 days before departure: 50% of the total tour price is forfeited.
- Less than 30 days before departure: 100% of the total tour price is forfeited.
- Permits & Accommodation: Please note that certain national park permits (such as gorilla trekking or special campsite reservations) and select luxury lodges are completely non-refundable once booked, regardless of when the cancellation occurs.
4. Itinerary Changes & Adjustments
While we make every effort to adhere to the confirmed itinerary, safaris and mountain climbs in East Africa involve travel in remote areas where conditions can change rapidly. We reserve the right to modify routes, transport, and accommodations if necessary due to road conditions, weather, safety concerns, or changes in national park regulations. Any minor adjustments will be of equal or higher standard.
5. Travel Insurance & Health Requirements
Comprehensive travel insurance is mandatory for all clients booking a tour with Kisaza Tours. Your policy must cover personal injury, medical expenses, emergency repatriation, search and rescue, and trip cancellation. For mountain treks (such as Mount Kilimanjaro), your policy must specifically cover high-altitude trekking (up to 6,000 meters).
Clients are solely responsible for ensuring they are medically fit for their chosen tour and have obtained all necessary vaccinations and health certificates (e.g., Yellow Fever, Malaria prophylaxis) required for entry into Tanzania.
6. Passports, Visas & Travel Documents
Clients must carry a valid passport with at least 6 months validity beyond their planned departure date from Tanzania. You are responsible for obtaining the correct visa (Tourist Visa) for entry. Kisaza Tours is not liable if you are denied entry into Tanzania or any destination due to missing or invalid travel documents.
7. Liability & Force Majeure
Kisaza Tours operates in compliance with Tanzanian laws. We act as an agent for hotels, lodges, transport companies, and airlines, and are not liable for injury, damage, loss, accident, delay, or irregularity caused by these independent suppliers.
We are not responsible for any delay, cancellation, or additional expenses caused by Force Majeure events, which include but are not limited to acts of God, war, civil unrest, strikes, government restrictions, extreme weather, epidemics, or flight cancellations.
8. Governing Law
These Terms of Service and any contract entered into with Kisaza Tours are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Tanzania.
